 Liylah, LLC Rental Agreement

Receipt of the Products. Once the Product(s) leave our possession, you gain full responsibility for any loss, damage, theft or other occurrence that may occur during transit or once in Your possession. Liylah, LLC bears no responsibility for any occurrence after the Product(s) leaves our showroom, but You will be held liable. If however, You opt to pick up your Products or have someone else pick them up for you at the Liylah showroom at 3725-A Old Court Road Pikesville, MD 21209. You agree to bear responsibility for receipt of Products shipped to the location specified at time of check out or someone else picking up for you in their possession at pick up. You acknowledge that a secure shipping address is highly recommended. A Secure Shipping Address is defined as a location where an individual can physically receive Product(s). In the event that an unsecured shipping address is provided, Liylah, LLC does not bear liability for Product(s) left unattended. Furthermore, You acknowledge that providing anything other than a Secure Shipping Address may result in delivery delays and additional delivery fees for which Liylah, LLC is not to be held liable, but You will be held liable.

Use of the Products. You agree to treat the Products with great care, as if it was borrowed from Your close friend. You are responsible for loss, destruction or damage to the Products due to theft, mysterious disappearance, fire, major stains or any other cause, other than normal wear and tear. Normal wear and tear encompasses minor stains, minor rips, missing beads, stuck zippers or other minor damage applicable to the Product(s).

Damage of the Products. If You return a Product(s) that is damaged beyond normal wear and tear, then You agree that we shall charge You, and You shall pay the price for repairing or replacing the Product(s), as determined in our discretion, up to 150% of the retail price of the Product(s).

Refund Policy. Liylah, LLC does not offer refunds for any dress rentals or reservations made either online or in the Liylah Showroom, with the exception of the refundable $75 trial deposit minus shipping costs for online orders. We will happily change your reservation to a different dress available or issue you a store credit which expires after 6 months. Credits are non transferable. Alternatively, you can chose a different gown that is available for the dates you need. If your reserved gown cost less than the new gown, the remaining balance will go toward a Liylah credit. If the reserved gown cost more you will be charged the difference.

COVID-19 Event Cancellation Policy If due to unforeseen circumstances an event is cancelled due to COVID-19, customers will receive a store credit valid for 1 year from date of reservation. Liylah, LLC does not offer refunds for any dress rentals or reservations made either online or in the Liylah Showroom.

Return of the Products; Extensions. You agree to return the Products to Liylah, LLC in the Return Packaging or garment bag on the return date for the Products that is identified in the online or in store invoice for Your order. You may exchange Your order for a Product on the Website or by phone to Liylah, LLC ; provided that any extensions are subject to other orders for that Product and to prepayment of the additional Rental Fee applicable to that Product for the period of time of the extension. You must return the Product by delivering the Product in the Return Packaging to a UPS store located in the United States or to the Liylah showroom at 3725-A Old Court Road Pikesville, MD 21209 by 12 p.m. on or before the date that the Product is due.

If You return the Products late or not at all, a late fee of eighty five dollars ($85.00) will be charged to the payment card You used to pay the Rental Fee or to any other payment card included in Your account information that You have provided to Liylah, LLC for every day that You are late returning the Product(s), and You agree to pay such late fees, up to an amount not to exceed double the Retail Value (posted on Liylah.com or in Liylah’s database) plus applicable sales tax (plus the Rental Fee). The late fee is payable for each order of Products that is not returned when due, not for each Product that is the subject of the order that is late. If you have not returned a Product within ten (10) days after the return date for the Product, Your late return will be considered a non-return and Liylah, LLC will charge Your payment card the maximum late fee set forth above, less any late fees that You have already paid, plus applicable sales tax.
If You lose the Return Packaging, You will be responsible for returning the item at Your own expense by the expected return date, and providing Liylah, LLC with a tracking number.

Collections. If You do not pay the amounts You owe to us when due, then we will need to institute collection procedures. If You file a charge back with your financial institution at any point after paying for Your product (with the exception of the product not being available to you before your event date) You agree to pay our costs of collection and administrative fees, including without limitation reasonable attorneys' fees.

Tailoring of the Products. Temporary hems and other forms of temporary tailoring of the Products is allowed  If You feel You require additional tailoring we encourage you to call our Personal Service team to discuss options. We are here to make sure You look Your best and will do all we can to make sure that happens!

Trials. Trials are due back within 48 hours of receipt unworn, undamaged with tags attached.

The late fee is payable for each order of Products that is not returned when due, not for each Product that is the subject of the order that is late. If you have not returned a Product within two (2) days after the return date for the Product, Your late return will be considered a non-return and Liylah, LLC will charge Your payment card the maximum late fee set forth above, less any late fees that You have already paid, plus applicable sales tax.

Worn or damaged trials are subject to fees up to an amount not to exceed double the Retial Value (posted on Liylah.com or in Liylah’s database) Plus applicable sales tax. If you return a worn or damaged Product Your return will be considered a non-return and Liylah, LLC will charge Your payment card the maximum late fee set forth above, plus applicable sales tax. 

What if I reserve my gown and then change my mind? We will help you choose a different gown and we will happily change the reservation to a different available gown for you. However, we don't offer refunds of any kind

What if I damage my rental? Wear and tear is understandable, so are minor tears or loose beading. That’s okay, just let us know at info@liylah.com and send it back as is. However, if Your dress is deemed damaged beyond repair, You will be responsible to pay double the retail price of the dress listed on the particular dress’ product page.

What if my dress is lost or stolen? You will be charged double the retail price listed for your rental in the event your dress is lost or stolen.

Should You want to insure your package, in the event that your package is stolen, lost or damaged in transit the shipping carrier will claim responsibility and You will not be held liable. Liylah, LLC is not liable for anything that may occur once the Product(s) leave our showroom, but You will be held liable. Additional fees apply, email info@liylah.com with the subject line "shipping insurance" to insure. 

What if I don’t send my dress back on time? (On time means in the hands of the carrier (USPS, UPS or FedEx) that is printed on the return label provided by Liylah on or before your specified return date) or in the case of a trial within 2 days from the date you receive the rental. First day late will be a $75.00 charge to your original form of payment. Every day there after will be a $95.00 charge to your original form of payment. After a dress is 7 business days late you will be charged double the retail price listed on our product page in addition to the daily late fees.

Shipping & Handling We use the most economical shipping carriers to keep costs down for you. We provide you with the return label to make the rental process simple. You may call the shipping carrier for a pickup or drop off at your nearest shipping location. 

Inside the original box is a return label. Just put that on top of the original shipping label (it’s already paid for)

Should You want to insure your package, in the event that your package is stolen, lost or damaged in transit the shipping carrier will claim responsibility and You will not be held liable. Liylah, LLC is not liable for anything that may occur once the Product(s) leave our showroom, but You will be held liable. Additional fees apply, email info@liylah.com with the subject line "shipping insurance" to insure. 

Dry Cleaning When You receive your dress it will be brand new or will have been dry cleaned for you. You should return to us worn and unwashed. We’ll take care of the cleaning.

 

Liylah, LLC, Liylah.com, Liylah, Liylah Rental, assume no responsibility  for typographical errors of any kind. Liylah.com and Liylah LLC have the right to change pricing on products at any time. Liylah or any employee of Liylah, LLC have the right to deny a rental for any reason deemed valid by Liylah, LLC.
